A training contract with To The Limit Gym GmbH is possible from the age of 16. Until the age of 18, a certificate from the legal representative must be presented. The legal representative is jointly and severally liable for all obligations.
The training contract is personal and non-transferable.
Membership with To The Limit Gym GmbH is personal and cannot be transferred. The member is therefore obliged to use the MemberCard exclusively in person and not to leave it to third parties. The training contract entitles the member to visit and use the facilities of To The Limit Gym GmbH in connection with their personal training. In the event of officially ordered closures, the member is not entitled to a refund, reduction, or reimbursement of the membership fee already paid. The same applies to an ordered mask or certificate requirement or similar. The member confirms and undertakes to comply with officially ordered measures (e.g., certificate requirement) and releases To The Limit Gym GmbH from all liability.
The entire membership fee is due upon conclusion of the contract or renewal of the contract. In the event of late payment, the member is no longer permitted to access the premises of To The Limit Gym GmbH. To The Limit Gym GmbH may charge reminder fees. In addition, default interest is due from the 1st reminder. To The Limit Gym GmbH reserves the right to commission a collection agency or to assign the claim.
The member is obliged to comply with the house rules (including hygiene regulations) and the General Terms and Conditions. The house rules and the General Terms and Conditions have been handed over to the member upon conclusion of the contract and are considered integral parts of the training contract. In the event of violations of the house rules or the General Terms and Conditions, To The Limit Gym GmbH is entitled to terminate the contract with immediate effect and to prohibit the use of the access code. In the event of a serious disturbance on the premises of To The Limit Gym GmbH, the member will be issued with a ban from the premises. There is no right to a refund of membership fees already paid.
The contract duration and prices are based on the memberships offered.
The member acknowledges and agrees that the use of the training facilities and equipment takes place without on-site supervision or attendance. To The Limit Gym is a place for independent training. The use of the training facilities and equipment is at your own risk and peril. Liability for damages in the event of accidents, injuries, and/or illnesses lies expressly with the member. To The Limit Gym GmbH assumes no liability for injuries or the loss of valuables, effects, money, clothing, etc. of the member within all premises. The member must adapt their personal training to their personal performance capacity. To The Limit Gym GmbH recommends having your fitness for training checked by a doctor before commencing membership. The member assures To The Limit Gym GmbH that they will only start training if the member is in good physical condition and there are no medical reasons or impairments that would affect the use of the training area or equipment. To The Limit Gym GmbH is also not liable for sold food and nutritional supplements.
The member is liable for any damage and/or soiling of the premises and training equipment caused by them and must fully reimburse To The Limit Gym GmbH for the corresponding repair, cleaning, or replacement costs.
If the member does not use the premises of To The Limit Gym GmbH, the member is not entitled to a refund or reduction of the membership fee (no "Time-Stop" option).
To The Limit Gym GmbH determines the facilities and equipment itself and decides which equipment will be replaced or purchased. To The Limit Gym GmbH can adjust opening hours and membership fees if circumstances require.
Aggressive behavior and sexual harassment will lead to immediate termination of membership without a fee refund and a ban from the premises. The member acknowledges and agrees that the training area is video-monitored for safety reasons. Other rule violations can also lead to contract termination.
All rights and obligations from this contract can be transferred by To The Limit GmbH to a legal successor.
By signing the training contract, the member simultaneously accepts the General Terms and Conditions and the house rules of To The Limit Gym GmbH. The latest version of the General Terms and Conditions and the house rules (Gym Rules) always apply.
Right to issue instructions The personnel present are authorized to issue instructions if this is necessary to maintain the orderly operation of the studio, order, and safety, or to comply with the house rules. These instructions must be followed.
The member is prohibited from smoking, consuming alcoholic beverages or narcotics in a studio. Furthermore, the member is prohibited from bringing prescription drugs that are not for the member's personal and medically prescribed use, narcotics and/or other substances intended to increase the member's physical performance (e.g., anabolic steroids), as well as alcoholic beverages into a studio. Similarly, the member is prohibited from offering, procuring, providing, or otherwise making accessible the aforementioned substances to third parties in the studios, whether for a fee or free of charge.
German law is applicable. The place of jurisdiction is Freiburg.
